These Terms and Conditions of Use (“Terms”) are entered into by and between you (“Client”) and Cold Creek Dog
Training (“Company,” “CCDT,” “we,” or “us”). These Terms govern your use of www.coldcreekdogtraining.com
(“Website”) and apply to all dog training services, including but not limited to Private Training Programs and
Immersion Board & Train Programs, whether purchased online, electronically, or in person.
By accessing or using the Website, submitting payment, signing electronically, or participating in training services, you
agree to be bound by these Terms, the applicable Training Agreement, Privacy Policy, and Disclaimer.

PRIVACY POLICY
Your use of the Website is also subject to the Company’s Privacy Policy, which governs our data collection practices.
Your agreement to the Privacy Policy is incorporated into these Terms.

DISCLAIMER
Dog training involves inherent risks, including unpredictable animal behavior. Results vary and are dependent on
numerous factors including environment, consistency, handler follow-through, and the dog’s temperament.

USE OF THE WEBSITE
To access or use the Website or purchase services, you must be 18 years of age or older and have the legal authority
to enter into these Terms. Information provided on the Website may change without notice. The Company makes no
warranties as to accuracy, completeness, or reliability.

LAWFUL PURPOSES
You may use the Website and services only for lawful purposes and agree to be financially responsible for all purchases
made by you or on your behalf.

USE OF FREE DOWNLOADABLE CONTENT
Any gated or downloadable content is licensed for personal or internal business use only and may not be copied, sold,
redistributed, or used to create derivative works without express written permission.

MATERIAL YOU SUBMIT TO THE WEBSITE
By submitting photos, videos, feedback, or other materials, you grant the Company a worldwide, non-exclusive,
irrevocable license to use such submissions for promotional and business purposes.

OUR INTELLECTUAL PROPERTY
All Website content, trademarks, logos, images, videos, text, and materials are the intellectual property of Cold Creek
Dog Training and may not be used without prior written consent.

PURCHASE OF SERVICES; PAYMENTS; REFUNDS

Private Training Programs: CCDT offers a 14-day satisfaction guarantee after the first lesson. Refund requests must
be made within 14 days of the first lesson and approved refunds are issued less processing and transaction fees. After
the 14-day period, no cash refunds will be issued. Unused training time will be issued as a credit only, usable within six
(6) months and transferable in accordance with the Training Agreement.

Immersion Board & Train Programs: A non-refundable deposit is required to reserve training dates. All payments are
non-refundable once paid, whether or not training has begun or completed. Payments may be exchanged for other
training services at the sole discretion of CCDT. Any approved refund will have applicable processing and credit card
fees deducted.

GUARANTEES
Lifetime Training Support Guarantees apply only to programs that explicitly include them. Lifetime support applies solely
to the behaviors and commands covered in the original program and does not extend to new behaviors or future issues.

ASSUMPTION OF RISK AND HOLD HARMLESS
By participating in training services, you voluntarily assume all risks associated with dog training activities and agree to
indemnify and hold harmless Cold Creek Dog Training, its owners, trainers, employees, contractors, and agents.

LIMITATION OF LIABILITY
To the fullest extent permitted by law, CCDT shall not be liable for indirect, incidental, or consequential damages. Total
liability shall not exceed the amount paid for the specific service giving rise to the claim.

AVAILABILITY
Website access and associated services may be interrupted or unavailable at times. CCDT is not responsible for
interruptions, delays, or system failures.

SECURITY
All information transmitted is done at your own risk. CCDT is not responsible for unauthorized access or data loss.

THIRD PARTY RESOURCES
CCDT is not responsible for third-party websites, links, or content and assumes no liability for their use.

INDEMNIFICATION
You agree to indemnify and hold CCDT harmless from any claims arising from your use of the Website or services.

EFFECT OF HEADINGS; SEVERABILITY
Headings are for convenience only. If any provision is deemed unenforceable, the remaining provisions remain valid.

ENTIRE AGREEMENT; WAIVER
These Terms, together with the Privacy Policy, Disclaimer, and Training Agreements, constitute the entire agreement
between you and CCDT.

GOVERNING LAW; JURISDICTION; MEDIATION
These Terms shall be governed by the laws of the Commonwealth of Pennsylvania. Any dispute shall be filed
exclusively in Pennsylvania courts. The parties agree to attempt good-faith mediation prior to litigation.
